A $50 deposit is due at time of booking to reserve the session date and time. The deposit is nonrefundable and is required to save a spot in our calendar. In the event the client cancels or changes the session date and time or is more than 30 minutes late to the session, the deposit is nonrefundable but transferable. The nonrefundable deposit will be transferable to a later date in the event circumstances occur beyond the client’s control (i.e. illness, death, unavoidable weather events). If the client cancels a session more than (1) time, the deposit is then forfeited, nonrefundable, and nontransferable at that time. If Kelsey Jade Photography voluntarily moves the session date due to circumstances beyond Kelsey Jade Photography’s control (i.e. illness, death, unavoidable weather events), and the client also agrees, the deposit remains nonrefundable but transferrable. 

The remaining session amount plus tax is due at the time of the session. If the client fails to pay the session fee, Kelsey Jade Photography reserves the right to withhold any images that were taken and will not edit them or send them out until full payment is received. Session fees include the session time, the photographer’s artistic interpretation, editing time, and the digital files. Late payments will be subjected to a $30 fee every 30 days the outstanding balance is not paid. Travel charges do not apply for sessions that take place at the Kelsey Jade Photography Studio or within 10-miles of Spearfish/Spearfish Canyon. Off-location sessions may incur a travel or mileage fee depending on the location. Kelsey Jade Photography is not held responsible for behavior of parties involved with the session, with the exception of studio personnel. If the desired outcome of your session is jeopardized by the behaviors of parties involved, including children and babies, Kelsey Jade Photography cannot be held responsible. 

Kelsey Jade Photography may capture many images during your session, but the Client will only see those images carefully selected by the photographer in the gallery. Each finished image is carefully edited by the photographer to ensure maximum artistry and technical perfection. Images with eyes closed, heads turned, duplicates, etc. will not be shown. No unedited images will be released under any circumstance. Raw photos are never given out. Basic and necessary touch-ups will be performed at the discretion of the photographer under Kelsey Jade Photography. The Kelsey Jade Photography style is classically considered “light and airy” – this means our whites appear very white and bright, colors are edited to be as true as possible, highlights are increased, and shadows are decreased. The client agrees that they are accepting of this style and no reedits will be performed unless the photographer deems necessary. Any additional edits will be at the photographer’s discretion only and may incur an editing fee.  

Once Kelsey Jade Photography provides the client with a digital gallery to download images, Kelsey Jade Photography’s contractual obligation is fulfilled. Refunds are prohibited and reshoots will be at the discretion of Kelsey Jade Photography only. Kelsey Jade Photography will make every attempt to provide the client with the digital files via online gallery within (3) weeks after the session date if everything is paid in full. Some sessions include limited digitals: clients will be provided a watermarked gallery with the option to select their 10 favorites. Once the 10 have been selected, a new sub-gallery will be created without the watermark and available to download. Additional digitals may be purchased separately in addition to prints & products. 

 Once you’ve received your gallery, it is advised you download and save your images right away. Galleries no longer expire; however, unforeseen circumstances may occur such as, but not limited to, website crashing, unretrievable images due to cloud storage malfunction, website updates or changes in web design, etc. Your purchase of the images releases Kelsey Jade Photography from any liability due to the loss or damage of the images or image gallery. It also releases Kelsey Jade Photography from any obligation to maintain copies of your images. Once the gallery is sent to the client, Kelsey Jade Photography will have no further contractual obligation to the client. It is in your best interest to back up your images (CD, USB, hard drive, online, etc.) at your own discretion. 

 The client understands and acknowledges that post-session sneak peeks posted to any social media outlet (including, but not limited to Facebook and Instagram) are a courtesy to Kelsey Jade Photography clients. These social media images are not to be reedited, cropped, or printed in any way, shape, or form. Instagram filters or any other smart phone/computer editing applications are to not, under any circumstance, be placed over a Kelsey Jade Photography social media sneak peek and reposted. There is absolutely NO editing to be done to the images unless done by Kelsey Jade Photography. Client editing breaches copyright law and the images are no longer an accurate representation of Kelsey Jade Photography’s artistic style and business. Furthermore, the client understands and acknowledges that sneak peeks to social media outlets are simply a courtesy and are not guaranteed nor a cohesive representation of a session in its entirety.  

Model Release: Kelsey Jade Photography reserves the right to use the images created under this contract for advertising, display, publication, or other purposes. Digital files and previews remain exclusive property of Kelsey Jade Photography. The client reserves the right to refuse the use of any images of their likeness on social media outlets (including, but not limited to Facebook and Instagram). The client is to make Kelsey Jade Photography aware of this request prior to the session date in writing. 

Kelsey Jade Photography retains copyright to any and all photographs and hereby grants the client private printing rights only. The client is to not, under any circumstance, provide any images taken by Kelsey Jade Photography for monetary gain, marketing, or commercial use unless otherwise noted via written permission by the photographer. Kelsey Jade Photography reserves the right to refuse or cancel service at any time as such a client/photographer or potential client/potential photographer relationship is deemed irreconcilable. 

 The photographer agrees to carry appropriate and legally required business and liability insurance, as required by the State of South Dakota. The Client shall assume all responsibility for their own safety and the safety of any other members of their party, including children and pets. The client and any person or animal accompanying the client releases Kelsey Jade Photography from all claims and liabilities of any kind.
